NOTICE TO MORTGAGEES PURSUANT TO C.R.S. § 38-33.3-217(1)(b)(I)
Declaration Amendment

Notice is hereby given to mortgagees holding an effective deed of trust encumbering a condominium unit subject to the Condominium Declaration for Aspenhof recorded in Pitkin County, Colorado on November 27, 1970 in Plat Book 4, Page 136 at Reception No. 143282, as amended (the "Declaration"), that the Aspenhof Condominium Association, a Colorado nonprofit corporation (the "Association") seeks to adopt an Amended and Restated Condominium Declaration for Aspenhof (the "Amendment"). The Declaration § 20 requires consent from holders of any deeds of trust that currently affect a condominium unit. In accordance with C.R.S. § 38-33.3-217(1)(b)(I)(A), the Association sent written notice of the proposed Amendment to each mortgagee at its last known address on June 29, 2020. Any mortgagee that does not deliver a response to the Association within 60 days of that notice shall be deemed to have approved the Amendment pursuant to C.R.S. § 38-33.3-217(1)(b)(II). Mortgagees may request a copy of the proposed Amendment from the Association as follows:
